Update Regarding the Purchase of Service Credit Case

This message is in follow-up to our recent e-mail messages related to the Fourth District Court of Appeal’s decision in the case between the City and SDCERS over service credits actually purchased or for which an application for purchase was submitted during the period of August 15, 2003, through November 1, 2003.

The SDCERS Board decided to form an ad hoc committee of three Board Members to work with SDCERS staff in determining what corrective steps to take in order to comply with the Court’s ruling.  This ad hoc committee is holding a public hearing next Friday, August 6 at 10:00 a.m. at SDCERS’ Board Room at 401 West A Street, 3rd Floor. The Committee will then bring various options to the full SDCERS Board at its public meeting on August 20 at 8:30 a.m. at the same location. Finally, the SDCERS Board will likely vote to implement one of those options at its October 1 Board meeting.

If you are affected by this Court ruling, we encourage you to attend the meetings on August 6 and/or August 20. MEA and our counsel Ann Smith will be there to make presentations at each meeting on your behalf, but those of you who can make it are also encouraged to attend and individually address the Board members about your own situation and the effect of any action taken by SDCERS. In addition, please contact your MEA representative at 619-264-6632 to let us know anything about your own personal situation that should be brought to the attention of SDCERS by your union.
